Summary of Bill S 748

Bill 119 s 748, also known as the Lytton Rancheria Reaffirmation Act, aims to reaffirm the applicability of the Indian Reorganization Act to the Lytton Rancheria of California. The Indian Reorganization Act, also known as the Wheeler-Howard Act, was passed in 1934 and aimed to reverse the assimilationist policies of the Dawes Act by promoting tribal self-governance and economic development.

The Lytton Rancheria is a federally recognized tribe located in California. This bill seeks to ensure that the Lytton Rancheria can continue to exercise their rights under the Indian Reorganization Act, including the ability to acquire land in trust for the tribe's use and benefit.

In addition to reaffirming the applicability of the Indian Reorganization Act to the Lytton Rancheria, the bill also includes provisions for other purposes. These purposes are not explicitly outlined in the summary, but may include provisions related to tribal sovereignty, economic development, or other issues relevant to the Lytton Rancheria. Overall, Bill 119 s 748 is a non-partisan piece of legislation that aims to support the rights and self-governance of the Lytton Rancheria of California by reaffirming the applicability of the Indian Reorganization Act to the tribe.

Congressional Summary of S 748

This bill applies the Indian Reorganization Act (IRA) to the Lytton Rancheria of California. Additionally, the bill authorizes the Department of the Interior to acquire and take land into trust for the benefit of the tribe under the IRA. Land taken into trust shall be part of the tribe's reservation.

A 2009 Supreme Court case, Carcieri v. Salazar, decided that Interior could not take land into trust for a specified tribe because that tribe had not been under federal jurisdiction when the IRA was enacted in 1934. This bill (1) affirms the applicability of the IRA to the Lytton Rancheria of California, thereby deeming the tribe to be under federal jurisdiction as of June 18, 1934, for purposes of the IRA; and (2) authorizes Interior to take land into trust for the benefit of the tribe.

This bill is so dumb, like why are we even wasting time on this? It's like, who even cares about this stuff? It's just a waste of taxpayer money. I don't see how this is gonna help anyone, especially me. Like, what's the point of all this? How is this gonna affect me in the long run?
