Summary of Bill HR 1435

Bill 118 hr 1435, also known as the Preserving Choice in Vehicle Purchases Act, is a piece of legislation currently being considered by the US Congress. The main purpose of this bill is to protect the rights of consumers to choose where they purchase their vehicles.

The bill specifically targets automakers who have been attempting to restrict or limit the ability of consumers to purchase vehicles directly from manufacturers. This practice has become increasingly common in recent years, with some automakers only allowing consumers to purchase vehicles through authorized dealerships.

The Preserving Choice in Vehicle Purchases Act aims to prevent automakers from engaging in these restrictive practices by prohibiting them from discriminating against consumers who choose to purchase vehicles directly from manufacturers. The bill also seeks to ensure that consumers have access to all available information about the vehicles they are purchasing, regardless of where they choose to make their purchase. Overall, the Preserving Choice in Vehicle Purchases Act is designed to promote competition and protect consumer choice in the automotive industry. It is currently being debated in Congress, and its ultimate fate will depend on the outcome of these discussions.

Congressional Summary of HR 1435

Preserving Choice in Vehicle Purchases Act

This bill modifies the waiver process under the Clean Air Act related to state emission control standards for new motor vehicles (or new motor vehicle engines).

Under current law, states are preempted from adopting or enforcing emission control standards for new motor vehicles (or new motor vehicle engines) unless the Environmental Protection Agency (EPA) provides a waiver authorizing a state to adopt such standards if certain requirements are met.

The bill provides that state standards that directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines are not eligible for waivers. The bill also prohibits the EPA from determining that any state standards amended after the bill's enactment are within the scope of an existing waiver.

Additionally, the bill requires the EPA to revoke waivers granted between January 1, 2022, and the date of enactment of this bill if the standards directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines.
