Summary of Bill HR 2333

Bill 119 HR 2333, also known as the "Protecting Students with Disabilities Act of 2021," aims to prevent the Department of Education from using allocated funds to eliminate, consolidate, or restructure any office responsible for administering or enforcing programs under the Individuals with Disabilities Education Act (IDEA). The IDEA ensures that children with disabilities receive a free and appropriate public education.

The bill seeks to safeguard the rights and educational opportunities of students with disabilities by maintaining the integrity and effectiveness of the offices within the Department of Education that oversee IDEA programs. By prohibiting any restructuring that could potentially weaken or undermine these crucial services, the legislation aims to uphold the rights and support systems for students with disabilities.

In addition to protecting the offices within the Department of Education that administer IDEA programs, the bill also includes provisions for other purposes related to safeguarding the rights and educational opportunities of students with disabilities. This legislation underscores the importance of ensuring that students with disabilities have access to the resources and support they need to succeed in their education. Overall, Bill 119 HR 2333 is focused on preserving and strengthening the programs and services that support students with disabilities under the IDEA, and it aims to prevent any actions that could potentially jeopardize the quality of education and support available to these students.

Congressional Summary of HR 2333

Protecting Students with Disabilities Act

This bill prohibits the use of appropriated funds to eliminate the Department of Education's (ED's) oversight of the Individuals with Disabilities Education Act (IDEA). (The IDEA authorizes grant programs that support special education and early intervention services for children with disabilities. Currently, the IDEA is administered by the Office of Special Education Programs in the Office of Special Education and Rehabilitative Services in ED.)

Specifically, the bill prohibits the use of appropriated funds to eliminate, consolidate, or otherwise restructure any office within ED that administers or enforces programs under the IDEA.

Further, appropriated funds may not be used to (1) terminate, reassign, or alter the responsibilities of any personnel of any such office; or (2) contract with, or delegate to, any entity outside of ED to administer or enforce IDEA programs.

(On March 20, 2025, President Donald Trump signed an executive order titled Improving Education Outcomes by Empowering Parents, States, and Communities, calling for the closure of ED and giving authority over education to the states. Further, the Trump Administration has announced plans to transfer ED's oversight of services for students with disabilities to the Department of Health and Human Services.)

I don't agree with this bill. It's going to make things more complicated for me and others like me. It's just not fair.
