Birthright Citizenship Act of 2024
10/15/2024, 11:53 PM
Summary of Bill S 5223
Bill 118 s 5223, also known as the Birthright Citizenship Act of 2024, is a piece of legislation currently being considered by the US Congress. The bill aims to amend the Immigration and Nationality Act to clarify that a person born in the United States is not automatically granted citizenship if at least one of their parents is not a US citizen or lawful permanent resident.
Under current law, the 14th Amendment to the Constitution grants citizenship to anyone born in the United States, regardless of the immigration status of their parents. However, supporters of the Birthright Citizenship Act argue that this policy encourages "birth tourism" and undermines the integrity of the US immigration system.
If passed, the bill would require at least one parent of a child born in the US to be a citizen or lawful permanent resident in order for the child to automatically receive citizenship. This would effectively end birthright citizenship for children born to undocumented immigrants or tourists. Opponents of the bill argue that it goes against the principles of equality and fairness enshrined in the Constitution, and could lead to stateless individuals who are born in the US but do not have citizenship in any other country. As of now, the Birthright Citizenship Act of 2024 is still in the early stages of the legislative process, and it remains to be seen whether it will garner enough support to become law.
