Terrorist Organization Classification Act of 2023
12/27/2023, 11:45 PM
Summary of Bill HR 2633
Under this bill, the Secretary of State would be responsible for determining whether an organization meets the criteria to be classified as a terrorist organization. The Secretary would consider factors such as the organization's history of engaging in terrorist activities, its capability to carry out such activities, and its intent to harm US citizens or national security.
Once an organization is classified as a terrorist organization, it would be illegal for any person in the US to provide material support or resources to that organization. This includes things like funding, training, and weapons. Additionally, the bill would authorize the freezing of any assets belonging to the organization within US jurisdiction. The bill also includes provisions for the review and potential removal of organizations from the terrorist organization list. Organizations would have the opportunity to appeal their classification and present evidence to support their case. Overall, the Terrorist Organization Classification Act of 2023 aims to strengthen national security by providing a clear process for identifying and combating terrorist organizations. It seeks to prevent the flow of resources to these organizations and hold them accountable for their actions.
Congressional Summary of HR 2633
Terrorist Organization Classification Act of 2023
This bill directs the Department of State to designate five specified drug cartels as foreign terrorist organizations. (Among other things, such a designation allows the Department of the Treasury to require financial institutions to block transactions involving the organization.)
The five specified cartels in the bill are MS-13, Queen Nation, Sinaloa, Cartel Jalisco Nueva Generacion, and Beltran Leyva Organization.
The bill also requires the State Department to submit a detailed report on those five cartels and any other cartels it may identify. Based on this report, the State Department must designate as a foreign terrorist organization any such identified cartel (or faction thereof) that meets certain criteria for designation as a foreign terrorist organization.
The bill specifies that it may not be construed to expand eligibility for asylum.
