Parity for HUBZone Appeals Act of 2021
12/30/2022, 5:47 PM
Summary of Bill HR 3845
Bill 117 HR 3845, also known as the Parity for HUBZone Appeals Act of 2021, is a piece of legislation currently being considered by the US Congress. The bill aims to address disparities in the Historically Underutilized Business Zone (HUBZone) program by providing a fair appeals process for businesses seeking to qualify for HUBZone certification.
The HUBZone program was established to promote economic development in historically underutilized areas by providing federal contracting opportunities to small businesses located in these zones. However, there have been concerns raised about the fairness of the appeals process for businesses that are denied HUBZone certification.
The Parity for HUBZone Appeals Act of 2021 seeks to address these concerns by requiring the Small Business Administration (SBA) to establish a formal appeals process for businesses that are denied HUBZone certification. This process would ensure that businesses have the opportunity to present evidence and arguments in support of their eligibility for the program. Additionally, the bill would require the SBA to provide clear and consistent guidance to businesses on the requirements for HUBZone certification. This would help to ensure that businesses understand what is needed to qualify for the program and reduce the likelihood of denials based on misunderstandings or misinterpretations of the rules. Overall, the Parity for HUBZone Appeals Act of 2021 aims to improve the fairness and transparency of the HUBZone program by providing a clear appeals process for businesses that are denied certification. This would help to ensure that eligible businesses have access to the federal contracting opportunities provided by the program, ultimately promoting economic development in historically underutilized areas.

Congressional Summary of HR 3845
Parity for HUBZone Appeals Act of 2021
This bill requires the Small Business Administration (SBA) to authorize its Office of Hearings and Appeals (OHA) to decide all appeals from formal protest determinations in connection with the status of a HUBZone small business.
A HUBZone small business is a small business in a historically underutilized business zone. Currently, HUBZone status appeals are the responsibility of the Office of Government Contracting and Business Development. The bill would place HUBZone status appeals within the purview of the OHA alongside other SBA programs such as the Service-Disabled Veteran-Owned Small Business program and the Women-Owned Small Business program.
