Purpose and Summary

Fair Representation Amendment

This resolution directs specified House committees to conduct a comprehensive review of laws within their jurisdiction and to recommend changes to eliminate excessive executive branch discretion in the application of those laws. Thereafter, the Committee on Oversight and Government Reform must report legislation containing all such recommendations with the short title Article One Restoration Act.

The requirement applies to the following House committees:

Agriculture
Armed Services
Budget
Education and Workforce
Energy and Commerce
Financial Services
Foreign Affairs
Judiciary
Natural Resources
Oversight and Government Reform
Science, Space, and Technology
Small Business
Transportation and Infrastructure
Veterans’ Affairs
Ways and Means
Permanent Select Committee on Intelligence

Bill 119 HRES 11, also known as the "Authorizing and directing certain authorizing committees to review laws within their jurisdiction and submit to the Committee on Oversight and Government Reform changes in such laws necessary to eliminate excessive Executive Branch discretion in the application of those laws," is a proposed legislation that aims to address the issue of excessive Executive Branch discretion in the application of laws.

The bill directs certain authorizing committees to review laws within their jurisdiction and identify areas where the Executive Branch has been given too much discretion in how those laws are applied. These committees are then required to submit proposed changes to the Committee on Oversight and Government Reform, which will ultimately decide on the necessary modifications to eliminate this excessive discretion.

The goal of this legislation is to ensure that laws are applied consistently and fairly, without allowing for undue influence or interpretation by the Executive Branch. By requiring a thorough review and potential revision of laws that grant excessive discretion, the bill seeks to promote transparency and accountability in the application of laws within the US government. Overall, Bill 119 HRES 11 aims to strengthen the rule of law and uphold the principles of checks and balances within the US government by limiting the Executive Branch's ability to interpret and apply laws in a manner that may be inconsistent with congressional intent.
