Ensuring Military Readiness Act of 2023

This bill requires the Department of Defense (DOD) to prescribe regulations regarding military service by transgender individuals.

The regulations must disqualify transgender individuals with a history or diagnosis of gender dysphoria from military service, with some exceptions. (DOD has defined gender dysphoria as a marked incongruence between one's own experienced gender and assigned gender.)

The regulations must provide exceptions for such individuals if they have been

  • stable for 36 consecutive months in their biological sex prior to accession; or
  • diagnosed with gender dysphoria after entering into service and do not require a change of gender and remain deployable.

Under the regulations, members of the Armed Forces who have been diagnosed with gender dysphoria may continue to serve in their current gender and receive medically necessary treatment for gender dysphoria. However, such treatment may not include gender reassignment surgery or the commencement of hormone therapy.

Transgender individuals who require or have undergone gender transition are disqualified from military service.

Additionally, transgender individuals who do not have a history or diagnosis of gender dysphoria and are otherwise qualified for service may serve in the Armed Forces in their biological sex.

Bill 118 HR 1064, also known as the Ensuring Military Readiness Act of 2023, is a piece of legislation currently being considered by the US Congress. The main goal of this bill is to ensure that the US military is adequately prepared and equipped to handle any potential threats or challenges that may arise.

One of the key provisions of the bill is the allocation of additional funding to the Department of Defense to support training and readiness programs for military personnel. This includes funding for exercises, simulations, and other training activities designed to enhance the skills and capabilities of the armed forces.

Another important aspect of the bill is the requirement for the Department of Defense to conduct regular assessments of military readiness and report their findings to Congress. This will help ensure that lawmakers are kept informed of the current state of readiness of the US military and can take appropriate action to address any deficiencies that may be identified. Additionally, the bill includes provisions aimed at improving the recruitment and retention of military personnel. This includes measures to enhance benefits and incentives for service members, as well as initiatives to support military families and improve the overall quality of life for those serving in the armed forces. Overall, the Ensuring Military Readiness Act of 2023 is focused on strengthening the readiness and capabilities of the US military in order to ensure that it remains prepared to defend the nation and its interests. It is currently being debated in Congress, and its passage would have significant implications for the future of the US military.
